Making Changes

Introduction

Things don’t always go as planned so in this section We want to talk about:

– Postponement

– Termination

– Cancellation

Initially We define what the first three terms mean:

Postponement – this is the act of changing a course start date of a course that is already booked and paid for but that has not yet started

Termination – this is when You decide to end a course that you have already started earlier than Your original course end date

Cancellation – this is when You decide not to take the course that you have bought and paid for before You even start it.

Cancellation Policy

Cancelling a course or accommodation after You have enrolled is governed by different regulations, so You should read this section very carefully before purchasing. We also strongly advise You to purchase an insurance policy that will cover You in the unfortunate event of having to cancel your booking.

Cooling Off Period

You have a right to a “cooling-off” period within which You can cancel Your booking for any reason.  This period begins once Your booking is accepted and We have sent You a booking confirmation, i.e. when the Contract between You and Us is formed.  The period ends at the end of 14 calendar days after that date. Refunds, where applicable, will be issued within 14 calendar days after You inform Us that you wish to cancel.  Refunds will be made using the same payment method You used when ordering the Services

If You wish to exercise Your right to cancel under this clause then You must inform Us of Your decision within the cooling-off period.  You may do so in any way You wish, though we would advise writing to admissions@ukenglish.org.uk - putting Your student ID in the subject line.  Cancellation by email or by post is effective from the date on which You send Us your message.  Please note that the cooling off period lasts for whole calendar days.  If, for example, You send Us an email or letter by 23:59 on the final day of the cooling-off period, your cancellation will be valid and accepted.

We may ask You why You have chosen to cancel and may use any answers You provide to improve Our services in the future, however please note that You are under no obligation to provide any details if You do not wish to.

Starting your course within the cooling off period

If the course begins within the cooling off period You are required to make an express request to that effect.  By requesting that the course begins within the 14 calendar day cooling off period You acknowledge and agree to the following:

  • If the course is fully performed within the 14 calendar day cooling off period, You will lose Your right to cancel after the course is complete.

  • If You cancel after provision of the course has begun but is not yet complete , You will still be required to pay for the course provided up until the point at which You inform Us that You wish to cancel.  The amount due shall be calculated in proportion to the full price of the course and the actual course already provided.  Any sums that have already been paid for the course shall be refunded subject to deductions calculated in accordance with the foregoing.  Refunds, where applicable, will be issued within in any event no later than 14 calendar days after You inform Us that You wish to cancel.  Refunds will be made using the same payment method You used when ordering the course.

Please note - the cooling off period does not apply if you have purchased your course or other services at our any of our centres. In this circumstance the usual cancellation policy, as outlined below, will apply.

Other Cancellations

If the cooling off period is no longer applicable, the following policy will be applied if You wish to cancel Your course:

If You wish to exercise Your right to cancel at any other time outside of the cooling off period then You must inform Us of Your decision as soon as you have made that decision.  You may do so in any way you wish using the methods below. Cancellation by email or by post is effective from the date on which you send Us your message. You may also contact us at:

Except where the cooling off period applies OR where we cancel a Service, all amounts You have paid for the course operated and delivered by Us (including amounts for optional course and additional fees) are non-refundable.

Exceptional circumstances - There may be special circumstances in which UKCE will consider converting fees or monies paid into a transferrable credit note once the 14-day cancellation period has passed. Any such case will be considered on its own merit and any decision taken will entirely be at the discretion of UKCE

 

Our right to cancel

Prior to arrival

We may cancel Your booking at any time before We begin providing the course in the following circumstances:

  • The required personnel and/or required materials necessary for the provision of the course are not available; or

  • An event outside of Our control continues for more than 13 weeks (please refer to Clause 16 for events outside of Our control).

If We cancel Your booking for above reasons and We have taken payment any such sums will be refunded to you as soon as possible and in any event within 60 days.  If We cancel Your booking, You will be informed by email, sent to the email account You used to book Your course.

Any refunds due under this clause will be made using the same payment method that You used when booking the course.

After Arrival

We may cancel the course after We have begun providing them due to an Event outside of Our control , or due to the non-availability of required personnel and/or required materials necessary for the provision of the Services.  In such cases, you will only be required to pay for Services that We have already provided up until the point at which We inform you that We are cancelling the contract.  Such sums will be deducted from any refund due to you or, if no refund is due, We will invoice you for the relevant sums.

Once We have begun providing the Services, We may cancel the Contract at any time and will give you at least 7 days written notice of such cancellation.  You will only be required to pay for Services that you have received.  Such sums will be deducted from any refund due to you or, if no refund is due, We will invoice you for the relevant sums.

If any refunds are due the they will be issued to you within 45 days and in any event no later than 60 calendar days after the day on which We inform you of the cancellation.  Refunds will be made using the same payment method you used when ordering the Services

In any respects We may cancel immediately by giving you written notice in the following circumstances:

  • You fail to make a payment by the due date as set out in .  This does not affect Our right to charge you interest on any overdue sums ; or

  • You breach the contract in a material way and fail to remedy the breach within 7 days of Us asking you to do so in writing; or

  • You contravene the Student code of Conduct or any other such breach as detailed in the above terms and conditions

Termination Policy

Accommodation

If You wish to leave Your accommodation early You must give notice, in writing, 4 weeks prior to the date of termination. Most of our third-party suppliers do not offer refunds for terminations of bookings, and therefore we advise that you book the minimum period that suits Your needs and extend thereafter.

If there are any variants to this standard clause they will be made clear at the time of booking

Course

After the start date of your course and the expiry of the cooling off period ( if relevant), any lesson hours reduced, cancelled or shortened are non-refundable, and cannot be substituted for any other course types.

Postponement Policy

You can postpone Your course;/ accommodation, but if You are going to do so You need to give as much notice as possible and You will need to do so by sending an email to Your course advisor. In that email tell us clearly the new date You wish to start your course.

If You have booked your course via one of our representatives abroad, please inform them as well as us.

You can postpone your course/accommodation a maximum of twice within 12 months of the original course start date, and You can only postpone Your course by a maximum of 6 months at a time. If you postpone, you may lose your chosen accommodation.

We will re-book Your course at the prices applicable to the prices in effect at the new start date and We will have to pass on to You any additional incurred actual costs for accommodation postponements, regardless of the notice provided.

If You are a visa student, we will inform the immigration authorities of any postponement.

For courses, any postponement made less than 7 calendar days before your start date will incur a fee equivalent to one week of the booked course.

Complaints Procedure

We always welcome feedback from Our customers and, whilst We always use all reasonable endeavours to ensure that Your experience as a customer of Ours is a positive one, We nevertheless want to hear from You if You have any cause for complaint.

All complaints are handled in accordance with Our Complaints Policy and procedure, which can be found on the Student Handbook.
